JUDGMENT / ORDER

Heard learned Advocate Mr. N.S. Sheth for the petitioner and Dr. Maulesh C. Shah-the respondent as party in person.
The applicant has moved the application for extension of time to deposit the amount of Rs.50,000/- as directed vide order dated 3-5-2001 in the proceedings of CRA no.502/2001.
It is stated at the Bar on behalf of the applicant that out of the amount of Rs.50,000/ordered to be deposited, the applicant has already deposited an amount of Rs.30,000/-and that the remaining amount of Rs.20,000/- shall be deposited today. That the applicant has no objection if the amount deposited is permitted to be withdrawn by the respondent.
In view of the above stated facts and circumstances, the petitioner shall deposit the remaining amount of Rs.20,000/- in this Court today and the respondent is permitted to withdraw the entire amount of Rs.50,000/- deposited, during the course of the day subject to final accounting in respect to suit claim made in the proceedings of Civil Suit no.1944/1999 Civil application thereby stands disposed of as withdrawn.
The proceedings of CRA no.502/2001 shall be notified on Board for further prosecution on 20th August,2001.
