This application is filed by petitioner praying for condonation of delay of 217 days in filing C.R.A. on the ground that after the order was passed, the certified copy was applied on 4th September, 2000 & the same was ready for delivery on 12/4/2001. Thereafter the petitioner has approached Legal Aid Committee of the High Court on 27/4/2001 & request for providing Legal Aid & it was granted by appointing advocate Chetnaben Joshi & accordingly Revision Application was filed, which is beyond time of 217 days. Mr.Buch Ld.adv. for Respondent on instruction from chief officer of the Nagar Panchayat states that the suit itself filed by petitioner being. R.C.S. No.15/94 is disposed of by the Ld.Trial Judge & Suit was dismissed by Ld.Judge. In view of statement made by Mr.Buch, nothing survive in this application nor even the order under challenge is in existance, this Civil Application as well as Civil Revision Application does not survive. Rule is discharged, no costs.
