JUDGMENT / ORDER

Hon'ble Ashok Srivastava,J.
Pursuant to our order dated 11.01.2010 Special Secretary (Housing and Urban Development) State of U.P,, Lucknow, Shri B.P.Singh is present in Court with record.
Learned counsel for State Shri D. K Upadhyay prays for further one week's time to find out as to who had been negligent in not calculating the interest amount for information to the petitioner. Shri D.K Upadhyay also informed that the petitioner as well as private Respondent had filed writ petitions seeking writ in the nature of mandamus or quashment on one count or the other. Hence, let this writ petition be listed with original records of Writ Petition No. 4085 (M/B) of 2009, W.P.No. 11 (M/B)1994 and W.P. No.446(M/B) of 1996 on the next date of listing. Shri D.K.Upadhyaya also brought to our notice that the property has now become valuable and the respondent nos. 4 and 5 in whose favour it is proposed to be resettled by declaring it freehold are ready to offer a higher amount.
Shri D.K.Upadhyaya also stated that in his personal opinion which is not based on instruction, it would be appropriate that the property is allowed to fetch higher price so that State Exchequer does not suffer. Be that as it may, we adjourn the matter for a week to be listed at 2 O'Clock on 11.02.2010 for final disposal. Special Secretary Shri B.P.Singh shall remain present on that date also for assistance to the Court.
List this matter on 11.02.2010.
