THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 16056 of 2008 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed in the year 2008 for the following relief:
“… Hon’ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus calling for the records relating to the
(1) G.O.Ms.No.175, dated 02.04.2005.
(2) G.O.Ms.No.95, dated 31.05.2005 issued repealing the terms of the G.O.Ms.No.175 and
(3) G.O.Ms.No.269, dated 16.12.2005 of the Home (General-A) Department, Government of A.P.
and quash the same by declaring them as illegal, improper, unsustainable and harmful to the general cinema viewers.”
We are of the view that the petitioner has no locus to challenge the above Government orders. It is the policy decision of the Government. Neither the petitioner nor any member of the public can be said to be affected by this decision. If the Government takes a decision with a particular idea, which does not affect any member of the public, no one can challenge the same. It is for the Government to take a review decision or not to take. The Court cannot give any mandate in this regard.
The writ petition is accordingly dismissed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
