JUDGMENT / ORDER

This writ petition has been filed on being aggrieved by the attempt to dig a bore well by the 5th respondent alleging that it is being digged for a commercial purpose without obtaining appropriate licence. When this matter is taken up for consideration today, it is submitted by the learned counsel for the petitioner that subsequently permit was granted to the 5th respondent by the first respondent Panchayat and in the said circumstances, the petitioner may be permitted to withdraw this writ petition with liberty to challenge the same before the appropriate forum in accordance with law. Recording the said submission, this writ petition is dismissed as withdrawn with the aforesaid liberty.
