JUDGMENT / ORDER

The petitioner herein is the first accused in C.C 562 of 2014 of the Judicial First Class Magistrate Court, Chalakudy. He has made an application for discharge under Section 239 of the Code of Criminal Procedure. His grievance is that his application for discharge is not being promptly and properly be considered by the learned Magistrate, and so he seeks a direction from this Court under Section 482 of the Code of Criminal Procedure for expeditious disposal of the said application. 2. As directed by this Court, the learned Magistrate submitted a report regarding the present stage of the application for discharge. This report shows that the petitioner filed application for discharge only on 23.8.2014, and it was posted for objection on 1.9.2014. As the learned Magistrate was on other duty on the said day, it was adjourned to 18.9.2014. From the report, I find nothing to blame the learned Magistrate that the application was Crl.M.C No.4995 of 2014 2 not promptly and properly considered. It appears that the present Crl.M.C is a mischievous one unnecessarily filed by the petitioner. I do not know where there is delay on the part of the learned Magistrate.
In the result, this Crl.M.C is closed, however with direction to the court below that the application for discharge filed by the petitioner shall be judiciously heard and decided.
