Heard learned counsel for the applicants and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceeding of Criminal Case No.828 of 2015(State Vs. Chunnu @ Aftab and others), arising out of N.C.R. No.46 of 2014, under Sections 323, 504, 506 IPC, Police Station Belghat, District Gorakhpur, pending in the Court of Civil Judge (S.D.)/Additional Chief Judicial Magistrate, Gorakhpur.
Learned counsel for the applicant submits that the applicant has already been enlarged on bail.
The argument raised by learned counsel for the applicant is largely factual which would involve an appraisal of evidence. Such exercise cannot be gone into in the present proceeding. However, in view of the objection raised by the learned counsel for the applicant, it is left open to the applicant to apply for discharge, in accordance with law, which may be decided as expeditiously as possible, preferably within a period of six months from the date of the production of a certified copy of this order.
