Heard learned counsel for the petitioner and Sri Piyush Shukla, the learned Standing Counsel.
Undisputedly, the husband of the petitioner was terminated from service. The challenge to that order failed. Aggrieved by the decision rendered by a learned Judge on Civil Misc. Writ Petition No.32622 of 1993, Special Appeal No.883 of 2019 has been preferred and which remains pending.
In view of the aforesaid, till such time as the special appeal is finally decided in favour of the petitioner, the claim for pension would not sustain. The view as taken by the respondents to the above effect clearly merits no interference.
The writ petition fails and is dismissed.
