Heard learned counsel for the applicants.
It is submitted that, with regard to the allegations levelled in the complaint, no doubt, initially, the applicants were misled by Harsukhbhai Dhanjibhai Vasoya to execute a power of attorney and other documents, but, as soon as the applicants came to know about the same by a public notice, they cancelled the said documents, namely, power of attorney, agreement to sale and MOU on 14.2.2007 and the said notice was published in a prominent vernacular newspaper, Gujarat Mitra, of South Gujarat edition, and, further, prior to the cancellation as above and subsequently, the above documents are not misused by the applicants by entering into any kind of transaction and the civil suit filed by the complainant against defendant No.2, who is accused No.4, is pending.
Issue notice returnable on 5.7.2012.
Ad-interim relief in terms of paragraph 8(c).
Learned APP waives service on behalf of the State.
Direct service is permitted qua the private respondent.
