The above matrimonial appeal is preferred against the judgment dated 11-02-2009 in O.P (G &W) No.902/2007 of Family Court, Kottayam at Ettumanoor. Though this court admitted the same and ordered to issue notice on 24-08-2009, no effective steps are taken to serve notice on the respondent. Even though the Registry has noted the defect in the address of the respondent, no steps were taken to cure the defect. It is also relevant to note that when the above matter was posted on 26-03-2014, there was no representation. Today also, though the matter is posted in the defect list, there is no representation and no step was taken to cure the defect. In the above circumstances, it appears that the appellant is not interested in prosecuting the matter after curing the defect. Accordingly, the above appeal is Mat. Appeal No.657 of 2009 2 dismissed for non-prosecution.
All pending interlocutory applications will stand dismissed.
