The present criminal revision is filed seeking quashing of the impugned order dated 01.12.2018 passed by the learned 8th Additional Sessions Judge/Special Judge (POCSO Act), Mathura, in Special Trial No. 857 of 2016 (State vs. Chotu) under Sections 363, 366, 376 IPC read with Section 3/4 Prevention of Children from Sexual Offences Act, P.S.- Refinery, District- Mathura.
After arguing at some length, counsel for the revisionist submits that he may be permitted to apply for a fresh medical examination of the girl with regard to her age.
It is open for the applicant to move such application before the Court below and in case, the applicant files such an application, the Court below shall consider and decide the same as expeditiously as possible.
With the aforesaid liberty, this criminal revision is consigned to record.
