Heard learned counsels for the parties.
Present writ petition is filed by the petitioner with the prayer to direct the Civil Judge(Junior Division), Kadipur, District-Sultanpur to decide the case no. 245/2017, suit for Partition(Chotey Lal Vs. Jagannath) pending before him since 30-05-2017. expeditiously as possible within the stipulated period.
Learned counsel for the petitioner submits that said suit is pending since 30-05-02017.
Looking into the facts and circumstances of the case, respondent no. 1,Civil Judge(Junior Division), Kadipur, District-Sultanpur is directed to consider and decide the case no. 245/2017, suit for Partition (Chotey Lal Vs. Jagannath) pending before him, in accordance with law, expeditiously as early as possible, from the date a certified copy of this order is placed before him. Learned Civil Judge(Junior Division), Kadipur, District-Sultanpur, shall not grant any unnecessary adjournment to the parties.
With the aforesaid, present writ petition is disposed of.
