Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the medical report does not support the averment made in the First Information Report. It appears that even the informant was not present on the spot. He has not seen the incident. However, the injury is simple in nature and the applicant is in jail since, 6.1.2009. There is no criminal history of the applicant.
In view of the aforesaid fact without expressing any opinion on merit, let the appellant Chotey alias Kaptan Singh be released on bail, in case crime no. 357 of 2008, under Sections 307, 504, 506 IPC, P.S. Amapur, District-Kansiram Nagar, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned. Order Date :- 27.1.2010 Manoj
