JUDGMENT / ORDER

Mr.
Shah, learned Advocate for petitioner has relied on a photocopy of indemnity bond which, according to the learned Advocate for petitioner, is executed on 28th March 2012. He has relied on clause No.3 of the indemnity bond wherein it is mentioned that the Special Civil Application No.5649/11 has to be withdrawn. He also submitted that he has also received telephonic instruction from his client (i.e. the petitioner) to withdraw the petition.
In that view of the matter, Mr. Shah, learned Advocate for petitioner has requested for permission to withdraw the petition.
Mr.
Pujara, learned Advocate for respondent has no objection if the permission as prayed for is granted. Therefore, below mentioned order is passed:
At the request of learned Advocate for the petitioner, permission to withdraw the petition is granted. In case of any difficulty, permission to Mr. Shah, learned Advocate for petitioner, to make appropriate request - application is granted.
With the aforesaid clarification, the petition is disposed of as withdrawn. Notice is discharged. Ad interim relief, if any, stands vacated forthwith.
