Writ Petition No.30047 of 2014
Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for issuance of a Writ of Habeas Corpus directing the respondent-police to produce the petitioner’s two minor children, viz., Vignesh, aged 9 years and Shaili, aged 7 years, who are in the illegal custody of the 6th respondent herein.
The grievance of the petitioner is that the petitioner’s mother-in-law has taken custody of the minor children. We think it is not the case of police detention either authorizedly or unauthorizedly. Hence, no Writ of Habeas Corpus lies.
Accordingly, the writ petition is dismissed. However, we give liberty to the petitioner to approach the appropriate forum for having his grievance redressed. No costs.
