HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.20195 of 2014 ORDER:
The petitioner was granted provisional licence bearing Licence No.2-6/2014-15, dated 28.06.2014, to establish and operate a retail shop in Yenamalakuduru, Penamaluru Mandal, Krishna District. The petitioner submits that there are some elements in the village, who are inimical and not allowing the petitioner to operate the wine shop. This action by the villagers is illegal and the petitioner is unable to protect himself from those unsocial elements. Having aggrieved by such illegal actions, the petitioner has submitted representation to the Circle Inspector of Police, Penamaluru Police Station, Vijayawada, Krishna District (6th respondent). However, this issue appears to have not been brought to the notice of the licensing authority.
2. Learned Government Pleader submits that no particulars of location of the shop are furnished in the affidavit filed in support of the writ petition and the grievance appears to be imaginary.
3. If the petitioner has a grievance, he shall ventilate the same or submit a representation to the Prohibition and Excise Superintendent, Vijayawada, Krishna District (4th respondent) giving all the particulars of establishment of the shop and nature of threat experience by him. Learned counsel for the petitioner submitted that the petitioner would submit a representation to the Prohibition and Excise Superintendent, Vijayawada, Krishna District (4th respondent) ventilating his grievance. As and when such representation is made, the 4th respondent shall consider the same and take appropriate steps, as warranted by law, if necessary, by bringing to the notice of the local police.
4. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
