Chittu Alais Muthammal vs The Commissioner

Madras High Court|03 December, 2009

JUDGMENT / ORDER

This writ petition has been filed by the petitioner praying for a writ of Mandamus, to direct the second respondent to restore the common water tap connection in front of the petitioner's house or a separate water connection inside her compound wall, on payment of necessary charges.
2. The main grievance of the petitioner is that the water connection, which was located 40 feet away from the petitioner's house, had been disconnected by the second respondent. The said public amenity was meant for the villagers, who are residing in the area, where the petitioner's house is located. However, the second respondent had disconnected the water supply, without informing the petitioner and the other users of the water connection, causing mental agony and hardship to those who are tapping water from the said water connection.
3. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the second respondent had submitted that the water connection in the Nagampatti Panchayat, Vedasandur Taluk, Dindigul District, has been provided and it is being used by the villagers. The said submission of the learned counsel for the second respondent has not been refuted by the learned counsel for the petitioner. In such circumstances, since no further order is necessary, the writ petition stands closed. No costs.
