Chittammal vs The Commissioner

Madras High Court|17 February, 2017

JUDGMENT / ORDER

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus directing the respondents to consider the Petitioner's representation, dated 20.1.2017.
2.Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the respondents 1 to 3.
3.By consent of both parties, the main Writ Petition itself is taken up for final disposal at the admission stage itself.
4.The Petitioner's grievance is that though he has been in possession and enjoyment of the property comprised in S.No.403/5, situated at Thottiapatti Village, Kovilpatti Highways at Kovilpatti, for more than 22 years, the fifth respondent had, without notice to her, issued a rental receipt in favour of one Kittappa. Aggrieved against the same, she had made a representation dated 20.1.2017 requesting the third respondent to issue a lease receipt to her. Since the said representation has not been considered so far, the Petitioner is before this Court.
5.In view of the limited scope of the prayer sought for in this writ petition and without going into the merits of the claim made by the Petitioner, there shall be a direction to the third respondent to consider the petitioner's representation, dated 20.1.2017 on its own merits, after giving due notice to the said Kittappa and pass orders on the same in accordance with law, as expeditiously as possible.
6.With the above direction, this Writ Petition stands disposed of. No costs.
