The instant contempt application has been filed for alleged violation of interim order dated 7.4.2010 in Writ-C No.18742 of 2010 extended on 6.7.2010.
It is not disputed before this Court that the aforesaid writ petition arose out of the proceedings under Urban Land (Ceiling & Regulation) Act, 1976. The respondents therein are State of U.P., Competent Authority, Urban Land Ceiling, District Magistrate/Collector and Kanpur Development Authority, Kanpur Nagar.
The petitioners have alleged violation of interim order of status quo passed in the writ petition as according to them, they were sought to be dispossessed in the month of July 2015 by Smt. Munni Devi, Sunita Bajpai and Kshama Bajpai. Concededly the above persons are not party to the writ proceedings.
In the considered opinion of the Court, in case possession of the applicants is being disturbed by some private persons claiming rival title over the land, the same would not amount to violation of the interim order passed by this Court against the State-respondents.
The contempt application is misconceived and is dismissed.
