The sole prayer survives for consideration is for issuance of a direction to the court below to decide R.M. Case No.57 of 2018 within a stipulated time frame.
Original Suit No.1984 of 2013 filed by the petitioner was dismissed in default on 9.3.2018. An application for restoration alongwith delay condonation application was filed on 3.7.2018. It is registered as R.N. Case No.57 of 2018. On 30.4.2019, the trial court had passed an order for summoning the record of the original suit.
Having regard to the above facts, the instant petition is disposed of with direction to the trial court to make serious endeavour to decide R.M. Case No.57 of 2018 expeditiously by fixing short dates and without granting unnecessary adjournments.
