JUDGMENT / ORDER

----------------------- The petitioner is an aspirant to admission in LLB Course-2014- 15 through sports quota. The petitioner submits that he has taken part in intra-district competition of Kozhikode in power lifting. Ext.P2 would show that the petitioner has secured third prize in intra- District power lifting champion ship held at 2014-15. The sports quota admission are referred in the prospectus issued by the Commissioner of Entrance Examinations. In Clause 11 (iii) stipulates that candidates seeking admission under the sports quota must take the Entrance Examination and also send a copy of the application to the Secretary of Kerala Sports Council. The above Clause further stipulates that the sports council will allot marks to these candidates according to their proficiency in sports.

According to the petitioner, he is the only candidate aspiring in sports quota and therefore the Sports Council shall recommend the name of the petitioner for admission for LLB Course under the sports quota. However the Sports Council failed to forward the recommendation to the Commissioner of Entrance Examinations. Consequently the petitioner was denied admission in three year LLB Course in sports quota.
3. In this matter statement has been filed by the Sports Council. The Sports Council produced Annexure A1 a prospectus to admission for prospectus for admission to professional Degree courses. The above prospectus also provide admission in sports quota in medical colleges. Annexure XVIII is appended with prospectus. Annexure XVIII according to the Sports Council is equally applicable to admission under sports quota to LLB Course. This is a criteria approved by the standing committee of the Kerala Sports Council. It is pointed out that a norm to the admission to professional colleges attached to Annexure XVIII would indicate that this would apply to LLB Course as well.
4. As matters stand now, according to the Sports Council, the only criteria followed by the Sports Council for awarding marks is based on Annexure XVIII. Sports quota seats are reserved for sports persons based on the list in Annxure AXVIII. The petitioner has taken part and secured third place is a District Championship conducted by the District power lifting Association. It is not a championship, which falls in the category for awarding grace marks as detailed in the norms. The petitioner took part only in an intra- district and hence he is not eligible for grace marks as given in the norms. The petitioner is not eligible for admission in sports quota.
5. On the other hand the learned counsel for the petitioner would submit that Annexure XVIII would apply when there is a competition among different sports parameters and restriction of choice is based on regulation as above.
6. Sports Council is guided based on the guidelines for awarding marks to the candidates for admission to sports quota. Note to Annnexue A would clearly indicate that this would apply to LLB Course as well. The petitioner has no case that he has taken part in any of the champion in Annexure AXVIII. Unless and until the petitioner represent any of the champion ship in Annuxure XVIII,the petitioner cannot seek an admission in sports quota. Sports quota admission is not granted based on the participation on any event but on the other hand based on participation part of any of the championship listed in Annexure XVIII.
In view of the above, the petitioner is not entitled for any relief in this writ petition. Accordingly this writ petition is dismissed. No costs.
