Heard learned counsel for the petitioner and Shri N.Mishra, learned counsel for respondent nos. 2 & 3.
Pursuant to the order of the Court dated 16.9.2015 passed in writ petition no. 53120 of 2015j, the petitioner has filed an appeal before the Director, Mandi Samiti, under section 27(3) of the Krishi Utpadan Mandi Adhiniyam, 1964 which is pending consideration.
Considering the facts and circumstances that has been brought on record, it would be open to the petitioner to move an interim application before the appellate authority which will consider and decide the application within three weeks from the date of production of certified copy of this order. It will also be open to the appellate authority to decide the appeal itself within the same period or within three months thereafter.
The writ petition is disposed of.
