Heard learned counsel for the applicants and learned A.G.A for the State.
This application under Section 482 Cr.P.C. has been filed with a prayer to decide the application dated 1.12.2017 given by the applicants under Section, 216 Cr.P.C. for amendment of the charges in Criminal Case No. 373 of 2016 (State Vs. Harendra and another), arising out of Crime No. 33 of 1995, under Sections 419, 420, 120B IPC, Police Station Machhalishahar, District Jaunpur.
Learned counsel for the applicants submits that the applicants' application for amendment of the charge has remained pending since 1.12.2017. The applicants are only deed writers and marginal witnesses and have been singled out for the purpose of framing of charges.
Considering the above, the instant application is disposed of with a direction to the Court below to decide the applicants' application in accordance with law, as expeditiously as possible within a period of three months from the date of the production of a certified copy of this order.
