ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents in not supplying essential commodities to the petitioner’s fair price shop bearing No.26 of Pasarlapadu Village, Rentachinthala Mandal, Guntur District, as illegal and arbitrary.
Learned Assistant Government Pleader for Civil Supplies of Government of Andhra Pradesh, on instructions, submitted that the petitioner’s authorisation has expired and that he has not made an application for renewal.
Sri P.S.P.Suresh Kumar, learned counsel for the petitioner, while fairly conceding that his client has not raised a pleading on this aspect, however, stated that he has applied for renewal.
Inasmuch as no plea as to the application for renewal much less evidence in support thereof has been raised in the Writ Petition, learned counsel for the petitioner requested for permission of the Court to withdraw the Writ Petition with liberty to his client to file a fresh Writ Petition with proper pleadings and evidence.
In view of the above, the Writ Petition is dismissed with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.37397 of 2014 filed by the petitioner for interim relief stands dismissed as infructuous.
