THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 1437 of 2014 JUDGMENT: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This appeal has been preferred against the judgment and order of the learned Single Judge dated 24.06.2014 by which His Lordship, after hearing the matter on affidavit, was pleased to hold that there has been an alternative remedy by way of an appeal.
It appears from the record that the appellant before us has made an attempt to prefer an appeal to the Commissioner, who, on receipt of the same, observed that he has no jurisdiction and the appeal should be placed before the appropriate appellate authority. Thereafter, the appellant has resubmitted the appeal when the judgment and order of the learned Single Judge has been accepted by act and action. Hence, we do not think it proper to entertain this writ appeal.
The writ appeal is accordingly dismissed. However, all points taken in this appeal will be available for urging before the appellate authority.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
