THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.85 of 2014 ORDER:
This petition is filed to transfer M.O.P.No33/2013 from the file of Senior Civil Judge, Rajam to any Family Court at Visakhapatnam for disposal in accordance with law.
2. Petitioner is wife and according to her affidavit, her marriage with respondent was performed on 03-07-2010 at Kailasapuram, Visakhapatnam and due to marital disputes, she is staying with her parents’ house at Visakhapatnam. She stated that she filed a criminal case and the same is pending at Visakhapatnam and respondent/husband is attending the Court at Visakhapatnam in connection of the said case. According to her affidavit, it is difficult for her to travel from Rajam to Visakhapatnam to defend M.O.P.No.33/2013 and for this reason, she sought transfer of M.O.P from Rajam to Visakhapatnam.
3. Respondent in spite of service of notice, neither appeared in person nor thorough advocate.
4. Considering the reasons stated in the affidavit and also considering the convenience of the wife M.O.P.No.33/2013 is withdrawn from Senior Civil Judge, Rajam and transferred to Family Court, Visakhapatnam for disposal in accordance with law.
5. Accordingly, the Tr.CMP is allowed. No costs.
