HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NOs.34624, 35919 & 35920 of 2014 Date: 05.12.2014 W.P.No.34624 of 2014 Between :

HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NOs.34624, 35919 & 35920 of 2014 COMMON ORDER:
On 15.10.2014, notification was issued by the respondent- corporation calling for applications for enlistment as dealer for retail outlet. One of the locations notified is Sarapaka at Sl.No.213. Respondent-Corporation issued another notification on 19.10.2014. In the said notification, two locations notified were Bhadrachalam at Sl.No.147 and Cherla at Sl.No.152.

In W.P.No.35919 of 2014 the challenge is to the notification dated 15.10.2014 for Sarapaka village outlet (Sl.No.213), in W.P.No.35920 of 2014 the challenge is to the notification dated 19.10.2014 for the location at Bhadrachalam (Sl.No.147) and in W.P.No.34624 of 2014 the challenge is to the notification dated 19.10.2014 at Cherla (Sl.No.152). The challenge is on the ground that all three locations are within the scheduled area, whereas locations are not earmarked to the local scheduled tribe persons, but are sought to be filled by non-local and non-scheduled category persons, which is ex facie illegal and unconstitutional.

When these matters are taken up for consideration, learned standing counsel representing respondent-corporation Sri Toom Srinivas produced communication sent to him, wherein he was informed that the respondent corporation has not received any applications for these three locations and, therefore, the selections are not taken up. Learned standing counsel, therefore, submits that writ petitions have become infructuous as selections are not taken up in these three locations since there was no response. Recording the statement of the learned standing counsel, these writ petitions are disposed of as cause in the writ petitions do not survive. There shall be no order as to costs.
Miscellaneous petitions if any pending in these writ petitions shall stand closed.
