In this writ petition, the petitioner has committed a blunder as in second Judge Copy he has filed proforma of some other writ petition, that is, Ram Asrey Gautam Vs. State of U.P. and others and affidavit has also been sworn accordingly which is apparently incorrect affidavit. The second Judge copy cannot be different from the first Judge copy.
This is first warning to learned counsel for the petitioner Sri Virendra Kumar, s/o Gayadeen, U.P.Enrolment No.8886 of 2002 not to commit such a mistake again.
That being the case and this defect cannot be removed, as such the writ petition is dismissed with liberty to file a fresh petition with better affidavit.
