Petitioner had applied for educational loan as she got admission in BSF College of Nursing (Indo American Hospital) at Vaikom, a college affiliated to the Kerala University of Health Sciences. The application for loan was rejected by the respondent bank informing the petitioner that she does not have qualifying marks in terms of the instructions received by them. 2. Statement is filed by the learned counsel for respondent inter alia referring to Annexure A1circular issued by the Personal Banking Business Department of the State Bank of Travancore. In Clause B with reference to eligibility criteria it is inter alia stated that a minimum of 60% marks, both for the qualifying examination as well as the qualifying subjects, is required for granting educational loan under management quota.

3. Learned single Judge of this court in Runa Varghese v Federal Bank (2014(2) KLT 764) has found that stipulating such qualifying marks is illegal as the same is against the Reserve Bank guidelines. In the light of the said decision I am of the view that the Writ Petition is only to be allowed.
Accordingly, Ext.P4 is set aside and the respondent is directed to provide educational loan to the petitioner without insisting for the qualifying marks in terms of Annexure A1 and on the petitioner complying with the other procedures as prescribed.
