Sri R.C. Upadhyay, learned counsel has accepted notice on behalf of the respondent no.5.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment over plot no. 1246 area 1.1220 hectare, which is a pond and plot no. 1355 and 1396 area 0.5320 and 1.055 hectares respectively which according to him is recorded as Banjar.
In the relief the plot no. 1396 does not tally with the plot mentioned in Annexure-3 to the writ petition. The plot no. 1355 is also illegible as from the document at page 21 it is not clear whether it is 1355 or1455.
For reasons aforesaid, the writ petition is dismissed.
