We formulate the following substantial question of law which arises in this appeal :-
"Whether the Appellate Tribunal has substantially erred in law by not appreciating the fact that the provisions of I.T. Act, including the amendment brought in by Finance Act, 2007 w.e.f. 1/4/2008 are applicable to the A.Yrs.2008-09 itself, and thereby setting aside the issues relating to disallowance of Rs.58,29,830/- made u/s.40A(3)(a) and of Rs.2,68,66,115/- made u/s.40A(3)(b) ?"
Issue notice to the other side. Paper book be filed within 3 months.
