This application u/s 482 Cr.P.C. has been moved seeking the direction to the concerned court below to decide the application moved on behalf of applicant u/s 156(3) Cr.P.C. as Case No.42 of 2017 (Chhuttan Ali vs. Ashim Ali), P.S.-Kotwali Gunnaur, District-Sambhal pending in the court of chief Judicial Magistrate, Sambhal at Chandausi expeditiously.
Heard learned counsel for applicant and learned A.G.A. and also perused the record.
It has been made to appear that there is some application dated 17.12.2017 moved on behalf of applicant pending in the court below but no orders have been passed on the same so far and a direction to get the same decided expeditiously has been sought by the counsel for the applicant.
In absence of complete record this Court is not in a position to know the exact status of the proceedings and also about the reasons as to why the aforesaid application has not been disposed of so far. At any rate, this application stands disposed of with the observation that if there is any such application dated 17.12.2017 as aforestated, moved on behalf of applicant still pending and no orders have been passed on the same so far, then the concerned court below shall look into the same and pass appropriate orders expeditiously in accordance with law, as it may deem fit in the facts and circumstances of the case.
