Heard learned counsel for the applicant and learned A.G.A. for the State respondent.
The present bail application has been filed on behalf of the applicant with the prayer to enlarge him on bail in case crime no. 47 of 2013 under Section 302, 307 and 34 IPC, P.S. Jaspura District Banda.
Learned counsel for the applicant has drawn attention of this Court to page no. 25, annexure-SA-6 to the supplementary affidavit dated 29.3.2018, and has argued that even bailable warrant has been issued against the witnesses and they are not appearing, thus, it is argued that trial is not likely to be concluded near future. The applicant is in jail since 25.5.2013.
Learned A.G.A. has contended that the applicant is the main assaulter and has opposed the prayer for bail.
After hearing the learned counsel for the parties and after perusing the material on record, this Court is of the opinion that no good ground is made out for enlarging the applicant on bail. The prayer for bail is hereby rejected.
However, the present bail application is disposed of finally with the direction to the court concerned to conclude the trial of the aforesaid case, expeditiously, preferably within a period of one year from the date of production of certified copy of this order before it, in accordance with law, without granting unnecessary adjournment to either of the parties, if proceedings is not stayed by any court of law.
