1. Ms.
Moxa Thakkar, learned A.G.P. has filed affidavit of one Jayantilal Nathalal Patel, Executive Engineer, dated 26th March, 2012, on behalf of respondents No.1 and 2. She pointed out that the award of the labour court, for non compliance of which, this contempt petition is filed, has been challenged by the Government before the learned Single Judge by filing writ petition. In such petition, on 23rd March, 2012, learned Single Judge while admitting the petition, granted interim relief qua continuity of service and back wages on condition that the workman shall be reinstated in service within a period of thirty days from the date of the order.
2. Learned A.G.P., under the instructions of Shri J.N. Patel who is present before the Court, stated that the reinstatement as provided in the order dated 21st March, 2012 passed by the learned Single Judge shall be carried out within the time permitted.
3. In addition to above statement, learned A.G.P. Ms. Thakkar has, on the basis of the affidavit in reply, tendered unconditional apology of respondents for delay in implementing the Court's directions.
3. In view of the above development, this contempt petition is disposed of. Notice is discharged. Needless to state that if the respondents did not act according to the statement made before us, it would be open for the applicant to approach this Court again.
