Office report with regard to the service of notice upon the respondents is incorrect.
The notices sent to the respondents on the delay condonation application have actually been received back after service and the said notices are on record.
In view of above, service upon the respondents is held to be sufficient. However no one has put in appearance on their behalf to contest the delay condonation application.
Having heard learned counsel for the appellant, I am satisfied with the explanation for delay in filing the appeal. Delay of 99 days in filing the appeal is hereby condoned.
Application allowed.
