Heard Sri A.K. Srivastava, learned counsel for the petitioner, Sri N.K. Verma, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer to quash the F.I.R. dated 16.5.2018, registered as Case Crime No.641 of 2018, u/s u/s 420, 467, 468, 471, 120-B, 504, 506 IPC, P.S. Vijay Nagar, district Ghaziabad.
Learned counsel for the petitioner submits that the daughter of respondent no.4 had eloped with the petitioner for which he lodged FIR u/s 363, 366 IPC which was challenged by the petitioner in 482 Cr.P.C. Application No.12217 of 2018 in which interim order has been passed in his favour by learned Single Judge of this Court on 19.4.2018, hence present FIR has been lodged against the petitioner with the allegation that the documents filed by the petitioner in the said case appears to be forged one.
Learned A.G.A. opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
