Heard learned counsel for the applicant and the learned A.G.A, for the State.
The complaint is under Section 363,366 IPC and Section 7 and 8 of the Protection of Children from Sexual Offences Act, 2012. The allegation is that the accused three persons enticed away the minor girl.
The victim in her statement under Section 164 Cr.P.C., stated that she is aged about 21 years and that she has herself left house voluntarily with applicant and has married him at Ghaziabad. The certificate of registration of the marriage dated 7.9.2015 is also enclosed.
In view of the above, let the applicant Chhotu alias Deshraj involved in Case Crime No. 343 of 2015 under Section 363,366 IPC and 7/8 PASCO Act P.S. Bhojpur District Moradabad be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
The trial court before accepting the personal bond of the applicant shall record the photograph of the applicant and his proof of identity for verification, if necessary, on future dates when the applicant appears in the court.
The identity, status and residence proof of the sureties be verified by the authorities concerned before they are accepted.
In case of any breach of any of the above conditions, the trial court will be at liberty to cancel the bail.
