Heard Sri Raj Kumar Mishra, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved by the accused- applicant Chhotey Singh, who is involved in Special Case No.8 of 2014, Case Crime No. 93 of 2013, under Section 394, IPC Police Station - Chaubia, District - Etawah.
Learned counsel for the applicant contended that applicant was on bail during trial. Applicant has gone out of station due to which he could not attend the Court on the date fixed and Non-Bailable Warrant has been issued against him. He is in custody since about 1-1/2 months.
Per contra, learned A.G.A. has opposed the prayer for bail.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant - Chhotey Singh be released on bail in the aforesaid case crime number on furnishing a personal bond and two heavy sureties of the like amount to the satisfaction of the court concerned.
Accordingly, the instant bail application is allowed.
