This petition for writ is preferred to have a direction for District Magistrate, Mirzapur to take appropriate action against respondent no. 3 on basis of inquiry report dated 22.09.2017 available on record as Annexure No. 2 to the writ petition.
It is stated that the petitioners are parents of the students who are undertaking education at A.S. Jubilee Inter College, Mirzapur. Respondent no. 3 who happens to be the Principal of the College aforesaid committed several financial irregularities as that is apparent from the inquiry report submitted by the City Magistrate to the District Magistrate, Mirzapur. It is asserted that no steps have been taken by District Magistrate by acting upon the report of inquiry.
On asking, learned counsel for the petitioners failed to satisfy us that under what capacity District Magistrate instructed the City Magistrate to make an inquiry in relation to an added educational institution and further in what capacity the City Magistrate conducted the inquiry. It is also not clear as to how the District Magistrate availed minute details about the accounts of the institution.
Be that as it may, having considered all facts of the case, we are not inclined to interfere in the matter by invoking the power under Article 226 of the Constitution of India. The writ petition, hence, is dismissed. The petitioners are at liberty to avail appropriate remedy.
