Heard Shri Rajesh Kumar Shukla, learned counsel for the petitioners and Shri Manish Mishra, learned standing counsel for the respondents.
In this writ petition, the petitioners are praying for the following reliefs:-
"i. Issue a writ, order or direction in the nature of MANDAMUS commanding the opp. parties not to make fresh allotment of patta in respect of the land in dispute during pendency of the writ petition No.30436/2018 (Chhotey Lal vs. Additional Commissioner (Administration) Faizabad Division, Faizabad) is still pending.
ii. Issue a writ, order or direction in the nature of MANDAMUS commanding the opp. parties to consider the name of the petitioners if any fresh allotment may be made during pendency of the writ petition No.30436/2018 (Chhotey Lal vs. Additional Commissioner (Administration) Faizabad Division, Faizabad) is still pending."
It is not in dispute that the Writ Petition No.30436/2018 (Chhotey Lal vs. Additional Commissioner (Administration) Faizabad Division, Faizabad) is still pending. In case, the petitioner is having any grievance, he may file appropriate application in the pending writ petition as aforesaid.
The present writ petition, filed by the petitioners, is not maintainable and it is accordingly dismissed.
