(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr.Chirag Patel, learned counsel appearing for the petitioners, Mr.Rakesh Patel, learned Assistant Government Pleader appearing for respondent nos.1 and 2 and Mr.Navin Pahwa, learned counsel appearing for respondent no.3.
2. The petitioners' names were not included in the provisional voters list and their application for inclusion of their names has been rejected by order dated 11.9.2012. Election of respondent no.3 which is a specified society, has been declared and election programme has been published on 11.9.2012 and nominations are to be filed upto 25.9.2012 and after various stages, election is scheduled to be held on 15.10.2012.
3. Election programme has been published. We are not inclined to interfere with the impugned order by which the petitioners' application for inclusion of names in the voters list has been rejected because the petitioners were earlier expunged, however, which was disapproved on 24.5.2012. But since the co- operative society has expelled the petitioners, their names were not included in the voters list. We are not inclined to interfere with the impugned order as the election process has already started. This petition is devoid of any merits and is accordingly dismissed. Notice is discharged.
