JUDGMENT / ORDER

Heard learned counsel for the applicants and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that since there was report from side of the applicant against deceased Ramchandra and two unknown persons who tried to commit theft and was beaten. Hence, subsequently, merely on the basis of suspicion applicant was falsely implicated in the present case along with other co- accused. Prayer for bail of co-accused Pandhari, Hari Shanker, Chhedi Lal, Smt. Usha Devi and Karma Devi have already been allowed by this Court. However ,the applicant is in jail since 07.5.2010.
The prayer for bail was opposed by learned A.G.A. He contended that applicant along with other co-accused inflicted injuries even prior to the aforesaid incident. The applicant along with other co- accused were involved in Maar-peet, regarding which report was lodged.
Considering the arguments of the learned counsel for the parties, without expressing any opinion on merits of the case, let the applicant namely, Chhote lal Yadav @ Babloo and Daya Shanker be released on bail in Case Crime No. 490 of 2010, under Sections 147, 149 and 302 I.P.C. and 3(2)(V) S.C./S.T. Act, P.S. Line Bazar, District Jaunpur on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
The applicant will report to the police station concerned on 10th of each month to show his good conduct and behaviour and he will cooperate with the trial.
In case of breach of the aforementioned condition, the Court below shall be at liberty to cancel the bail.
