The petitioner has challenged the order dated 22.8.2007 whereby the respondent no.2 has rejected his building plan on the ground that the matter in respect of the acquisition of the land was pending in the Supreme Court and hearing was in progress.
The writ petition is pending since 2007. On the last occasion, learned counsel for the petitioner sought adjournment to verify the fact whether the writ petition has become infructuous or not.
No one is present in the revised call.
We have perused the material on the record and we feel that due to efflux of time, the writ petition has become infructuous.
Accordingly, the writ petition is dismissed as having become infructuous. We grant liberty to the petitioner to move recall application if the cause of action still survives.
