Heard learned counsel for the petitioner and learned A.G.A. for the State through video conferencing.

Learned counsel for the petitioner after arguing at length has prayed that he may be permitted to withdraw this writ petition with the liberty to take appropriate remedy before the competent court, if the cause so arises.

The investigation in respect of the F.I.R. relating to which the prayer has been made is at a nascent stage and the relief prayed for hereinabove even otherwise is not maintainable under article 226 of the Consititution of India.

Accordingly, the present writ petition is dismissed as withdrawn.
