Heard learned counsel for the petitioner, learned Standing counsel and Sri Mahboob Ahmad, learned counsel for the respondent nos. 2 and 3.
The petitioner by means of this writ petition has made a prayer to issue a writ, order or direction in the nature of certiorari quashing the recovery proceedings initiated against the petitioner for recovery of the amount mentioned in the bill dated 20.12.2017.
Learned counsel for the petitioner has very fairly stated that the petitioner is ready to make payment of the amount mentioned in the bill dated 20.12.2017 but present financial condition of the petitioner is not such so as to enable him to deposit the entire payment of dues against him in one stroke, he further submitted that the petitioner is ready to make payment of the dues against him in such instalments as this Court may direct.
Sri Mahboob Ahmad, learned counsel appearing for respondent nos. 2 and 3 has no objection to the prayer made by the learned counsel for the petitioner.
In view of the above, this petition is finally disposed of with direction to the petitioner to deposit the amount demanded by the electricity department by the impugned bill dated 20.12.2017 in four equal monthly instalments. The first instalment will be paid by the petitioner on or before 31st March, 2018. In case the petitioner deposits the amount demanded from him as per the instalments indicated hereinabove, no coercive action shall be taken against him.
In case the petitioner commits default, the respondents will be at liberty to proceed against him in accordance with law.
