This writ petition has been filed for a direction upon respondents to release all retiral benefits and pension payable to petitioner.
Sri Bharat Singh Pal, holding brief of Sri Neeraj Tripathi for the respondents has obtained instructions, according to which petitioner has already been sanctioned provisional pension and the same is being paid to him. It is stated that criminal proceedings under Section 302 IPC are pending against the petitioner, and therefore, final pension has not been determined so far. It is further stated that as soon as criminal proceedings are finalized, the authorities shall process and release the regular pension to petitioner.
In the facts and circumstances, it would be appropriate to permit the petitioner to represent in the matter before respondent no.2, alongwith certified copy of this order, within two weeks from today, in respect of his grievance annexing all relevant materials in support of his claim. The authority concerned shall pass a specific order with respect to the grievance raised by the petitioner, in accordance with law, within a further period of three months, thereafter.
