Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
Petitioner is aggrieved on account of impleadment of respondent no.3 in the mutation case filed by the petitioner. The impleadment has been ordered on the application of respondent no.3 Against the impleadment order, a revision filed by the petitioner has been rejected.
The proceedings wherefrom the writ petition arises are summary mutation proceedings and entertaining the writ petition would necessarily entail a delay in its disposal. Moreover and since petitioner still has every opportunity of canvassing her case on the merits of her claim, this Court does not find any reason for the petitioner to be unduly aggrieved by the impugned orders. In any case, mutation proceedings do not determine the title of the parties, thereto.
However, looking into the facts and circumstances of the case, this writ petition is disposed of directing the Court concerned, namely, the Tehsildar, respondent no2 to proceed with the mutation case, expeditiously and to ensure positively that the mutation case does not get lingered on account of the conduct of the newly impleaded party.
