By order and judgement dated 12.3.2018 in Writ-A No.43122 of 2016 filed by the applicant, this Court directed the Regional Manager, UPSRTC to pay entire arrear of salary to the petitioner within a period of six weeks from the date of receipt of certified copy of the order. There is a further direction to pay interest @ 12% in case of delayed payment.
Learned counsel for the applicant points out that a certified copy of order of the Writ-Court was sent to the opposite party on 21.3.2018 followed by reminder dated 13.6.2018, but no decision has been taken in the matter so far nor arrears of salary has been paid.
This Court is of the opinion that before inaction on part of the opposite party in complying with the directions issued by the Writ Court is treated as wilful disobedience, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order alongwith fresh representation before the opposite party and in which event, he shall ensure compliance of the directions issued by the Writ-Court within next eight weeks. In case the directions are yet not followed, as directed, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
