Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed with a prayer to quash the order dated 4.12.2017 passed by learned Judge, Family Court/F.T.C.-2, Etawah arising out of Suit No. 251 of 2016, under Section 125 Cr.P.C., Police Station Saifai, District Etawah (Smt. Mamta Devi Vs. Chhaviram Singh), pending in the Court of Judge, Family Court/F.T.C.-2., Etawah.
The present application has been filed against the order dated 4.12.2017, by which the interim maintenance @ of Rs. 1000/- towards opposite party no.2 and Rs. 500/- each towards her one son and daughter have been awarded. The final orders on the application under Section 125 Cr.P.C. are still awaited. It has also been submitted by learned counsel for the applicant that there is some room for settlement in the matter.
Having considered the above, I do not find any good ground to interfere in the application, at this stage inasmuch as final orders on the application under Section 125 Cr.P.C. are still awaited and the interim monthly maintenance allowance provided for his wholly nominal and minimal as is necessary to preserve human life and dignity.
No interference is warranted at this stage. The application is dismissed.
