Chhatrasinh vs Keshiben

High Court Of Gujarat|19 April, 2012

JUDGMENT / ORDER

Present Civil Application under Section 5 of the Limitation Act has been preferred by the applicant herein - original appellant to condone the delay of 62 days caused in preferring the Second Appeal challenging the judgment and order passed by the learned Principal District Judge, Panchmahals, at Godhra dated 13.04.2007 passed in Regular Civil Appeal No.19 of 2005.
Though served, nobody appears on behalf of the respondent Nos.1/2/1 to 1/2/4 and 1/3 to 1/6.
Hence, it appears that there is no opposition to the present application. Even otherwise considering the averments in the application, it appears that sufficient cause has been shown. Hence, delay caused in preferring the Second Appeal is hereby condoned. Rule is made absolute accordingly. Registry is directed to notify the main Second Appeal for admission hearing on 30th April 2012.
